Belgium to introduce €1,260 on-the-spot fine for foreign DUI drivers

From 1 January 2025, foreign drivers caught under the influence of alcohol or drugs on Belgian roads will be required to pay a deposit of €1,260 on the spot.

This measure, reported by Het Nieuwsblad, has been confirmed by the office of outgoing Justice Minister Paul Van Tigchelt.

The proposal for the royal decree was originally presented in 2023 by outgoing Mobility Minister Georges Gilkinet.

According to the Gilkinet's office, the main reason for this is that fines for foreign drivers often go unpaid. Starting next year, police will therefore have the authority to demand an immediate deposit of €1,260 from any foreign driver found under the influence.

Driver penalties aim to reduce unpaid fines

This amount will be deducted once the judge issues a verdict in the police court.

The €1,260 is the minimum fine, which includes legal fees, for first-time offenders caught under the influence of drugs, according to the Ministry of Justice.

Drivers who cannot or refuse to pay will have their vehicles impounded for 96 hours by the police. If the payment is not made within this period, the vehicle may be seized. Additionally, the owner will have to cover towing and impound fees.
