The Flemish Government’s decree from March 2023 aimed at addressing the PFAS pollution from the 3M factory site in Zwijndrecht has been annulled by the Council of State, announced on Thursday.
This decree consolidated terrains within a 5-kilometre radius around the factory into a single site, to handle the pollution comprehensively rather than by individual parcels.
However, the Council of State ruled that the regional government cannot impose stricter regulations on one party than those stipulated in the Flemish soil decree.
The court observed that several provisions increased the obligations on 3M without the company’s consent.
