A 49-year-old man and his 57-year-old ex-partner were convicted of rape in the Kortrijk District Court on Tuesday.
After spending the night at a bar in town, the two had taken a woman home and raped her. The man received a prison sentence of 4 years, including 1 year with a reprieve, and the woman received 15 months in prison with a reprieve.
"He had fantasised about a threesome before," said the victim's lawyer.
The facts date back to 21 April last year. The victim went with two other couples to café Het Landhuis in Bavikhove, where there was heavy drinking. At a certain point they all went to the home of Mario V. "But when my client wants to go home, V. stops her and takes her to the bedroom," said the civil party's lawyer.
"In doing so, his then-girlfriend is also present. They both take off their clothes and force her to do the same. When she refuses, V. rips her blouse. Despite her vehement resistance, she was penetrated by one defendant and orally satisfied by the other."
V. is said to have previously indicated that he fantasised about a threesome with the two women. During his interrogation and before the judge, he denied it.
According to him, he took the victim to the bedroom so she could sleep off her intoxication and the two women conspired against him.
The other defendant, his then-partner, confessed to the facts. "This should never have happened, I am very ashamed," he said.
The judge on Tuesday sentenced the man to 4 years in prison, 1 of which was suspended. The female defendant received 15 months in prison, fully suspended.
